Criminal Sentencings

Michael Anthony Kuest, 27, of Odessa, pleaded guilty April 23 to attempting to elude a pursuing police vehicle during a Jan. 16 incident in the Odessa area. His sentence includes 75 days in jail or 60 days electronic home monitoring, plus payment of $700 in court assessments.

Austin Justus Proctor, 26, of Almira, pleaded guilty April 23 to second-degree trafficking in stolen property in connection with the taking of jewelry from a Rocklyn Road residence between July 21, 2018, and Feb. 17 of this year. As a result of plea negotiations, prosecutors amended the charges from second-degree theft and first-degree trafficking in stolen property. His sentence includes three months in jail, restitution to be determined later and payment of $800 in court assessments and $500 for public defender reimbursement.

Civil Judgments

LVNV Funding won a $1,910.76 default judgment against Dawn Sherrett, of Davenport, in a matter involving credit account debt.

Teresa Kay Brodrick’s petition for a domestic violence protection order against Rodney R. Schmidt was denied April 16 due to insufficient evidence to prove the claim. Both parties are Edwall residents.

Jeffrey Daniels, doing business as RJD Iron Works of Davenport, must pay $324.52 for worker compensation taxes to the Washington State Department of Labor and Industries.

Davenport Building Supply, of Davenport, must pay $1,331.50 for worker compensation taxes to the Washington State Department of Labor and Industries.

New Criminal Cases

Cindy Ann Angell, 60, of Spokane, is charged with third-degree assault and resisting arrest in connection with an April 12 traffic stop on Morgan Street in Davenport during which Lincoln County Sheriff’s Deputy Jerad McLagan was punched in the side of the face. The incident also involved the use of a tazer device. Alcohol and/or drugs also may have been a factor.

Donald Keith Smith, 61, of Odessa, is charged with second-degree assault (domestic violence) in connection with an April 23 incident during which a resident of the 100 block of East 3rd Street in Odessa reported being attacked with a knife.
