Motion for appeal bond denied in Hood case

Defense asked for $5,000 bond while awaiting appeal

DAVENPORT—Presiding judge Dan B. Johnson denied a motion for an appeal bond by the defense of Brandy J. Hood at a hearing Tuesday, March 8.

Hood was sentenced to 43 months in prison Feb. 22 after a jury found her guilty on four counts of fourth-degree assault, two counts of second-degree assault and one count of harassment with the threat to kill stemming from incidents involving mistreatment of Hood's two daughters in Jan. 2020.

Defense attorney Douglas Phelps motioned for a $5,000 bond Tuesday. Prosecuting attorney Nina Fisk said Hood shouldn’t have a right to an appeal bond.

“She’s likely to pose a danger to others…if released,” Fisk told the court. “The victims believe she will flee, and her crimes are significant…She has incentives to flee.”

Fisk added that if Johnson chose to allow a bond, that be raised to $100,000.

Phelps said that Hood has pending medical appointments and would need to be released from custody for those, saying “the history of the case doesn’t warrant the state’s request.”

Johnson said the serious incidents Hood was found guilty of gave him “no problem” to say Hood likely would flee if allowed bond and potentially pose danger to others, including the victims in the case.

He then denied the motion, saying “I don’t know if this is even a particularly close matter.”

Hood will remain in custody while awaiting an appeal to her 43-month sentence. She is currently booked in Lincoln County Jail.
