Attorneys are awaiting federal decision
DAVENPORT — The trial of a Sprague man accused of possessing over 100 images and videos displaying child pornography was continued to Feb. 21 as Lincoln County attorneys wait to see whether the case will be picked up federally.
Jonathan Ray Stocker, 42, is charged with five counts of first-degree possession of depictions of minors engaged in sexually explicit conduct and one count of second-degree possession of depictions of minors engaged in sexually explicit conduct after police allegedly discovered over 100 child pornography-related files on a laptop at his Sprague Highway Road residence.
Deputy prosecuting attorney Ty Albertson moved for a continuance at a hearing Tuesday, Nov. 28, while public defender Dave Hearrean agreed based on a lack of federal decision.
“We haven’t heard a final answer from the feds,” Hearrean said. “We thought they were going to pick up the case, but we haven’t heard for sure yet.”
Albertson said the continuance was also necessary due to the substantial amounts of evidence to study, which he said the Dept. of Homeland Security is assisting the state with.
Superior Court Judge Jeffrey S. Barkdull continued the trial from the original Dec. 20 date, with a readiness hearing set for Tuesday, Jan. 30.
Stocker has remained in Lincoln County Jail since he was arrested Friday, Sept. 1.
