Spokane Man Charged with Theft

Elementary school cameras catch alleged criminal

DAVENPORT — A Spokane man faces second-degree theft charges and will appear in Lincoln County Superior Court after video footage from outside Davenport Elementary School captured both the theft and his vehicle.

Zachary Stephen Rose, 33, of Spokane, has been summoned to appear in Lincoln County Superior Court to face a charge of second-degree theft.

Rose was arrested on Friday, June 28, following a report of theft received by a Lincoln County Sheriff’s Deputy.

According to court documents, Marie A. Plasencia, 46, of Davenport, reported the theft of several items, including a Milwaukee Packout box, a ½” high-torque impact wrench kit with two batteries, a Milwaukee Hammer drill, a Milwaukee Impact driver, a two-pack of Milwaukee batteries, a Milwaukee hammer, a Milwaukee screwdriver set, Klein Lineman’s Pliers, Klein Channel Locks, a Milwaukee screwdriver bit set and miscellaneous tape and small items.

The Pack Out Kit had custom markings with blue tape on the handles and the initials “EP, SP, OR, AP” on the tops of the batteries.

The Lincoln County Sheriff’s Office estimates the total value of the stolen tools at $1,605.

Plasencia informed Deputy Justin Wynecoop that the tools were left outside in front of her garage, which was reportedly closed.

Deputy Wynecoop stated in a warrantless arrest probable cause statement, “Plasencia informed me that Brian Telford, who works at Davenport Elementary School, had video footage of the vehicle involved in the theft.”

The residence where the theft occurred is located across the street from Davenport Elementary School.

The school’s video footage, which records in short clips based on motion sensors, shows a red Mazda extended cab pickup stopping in front of the residence around 3:30 a.m.

The video reveals the tools before the vehicle’s arrival and captures a tall, thin male exiting the vehicle. When the vehicle leaves, the tools are no longer visible. No other vehicles are seen in the area between the presence and disappearance of the tools.

On Saturday, June 29, at 1:02 a.m., Deputy Wynecoop was informed that the same vehicle was parked outside Plasencia’s residence.

“Plasencia told me a red pickup was parked across the street from her in the school parking lot. She believed this was the same vehicle from her previous camera recordings,” said Wynecoop.

Plasencia’s son, Ethan Plasencia, 20, checked on the vehicle’s occupant, which had its hood up. After Ethan confronted the man, the vehicle drove off at high speed, crossing parking spots in Davenport.

Deputy Wynecoop conducted a traffic stop on the vehicle and identified the driver as Zachary Rose.

“I identified the driver via his Washington driver’s license. I noticed Rose lives out of county,” Wynecoop added.

When asked why he was in Davenport at 1:30 a.m., Rose claimed he was working as a roofer for “A New Haven” on 7th and Maxwell and was in town to retrieve his tools. However, Wynecoop did not observe any of the stolen items in the vehicle or its bed.

Chief Criminal Deputy Becker later reported retrieving a FLOK camera hit on the same vehicle with the same Washington State license plate out of Spokane.

The vehicle was observed at Morgan Street and State Route 25 at 3:40 a.m. on Tuesday, June 25, with items in the back that appeared to match those reported stolen by Plasencia.

Based on eyewitness statements, video footage and Chief Becker’s supplemental report, Deputy Wynecoop established sufficient probable cause for the charge of second-degree theft.

Rose was arrested and booked with a $10,000 cash bail.

Reports indicate that Cassandra L. Rose of Colbert paid the bail.
