Davenport man to be arraigned for rape

Daniel James arrested in Sept. 28 case

DAVENPORT — A local man will be arraigned Tuesday, Oct. 8, after being accused of raping a local woman in his vehicle.

Daniel R. James, 24, is being held on $50,000 bail on a charge of second-degree rape-forcible compulsion.

James appeared before Judge Pro Tempore Dan B. Johnson on Oct. 1, three days following his arrest Saturday, Sept. 28.

According to a probable cause statement filed with the court, the woman notified law enforcement officers of the rape.

The woman told police she had been out drinking with friends and asked James for a ride home from 106 Main St. at 3:45 that morning, records show. Rather than take her home James drove the victim to a secluded area, where the victim said they talked and listened to music off a dirt road.

James then pulled down her pants, pushed her in the back seat and raped her, court records show.

After the alleged incident, James dropped the woman back off where he picked her up, records show. He went home; she went inside and told her friends about the incident. She then contacted her mother and together they contacted law enforcement.

Investigators contacted James life-in girlfriend, who told them he came home about 4:45 a.m., records show. The girlfriend told officers she learned of the alleged incident from one of James’ friends.

Based on the evidence, officers contacted James and arrested him.

James, however, denied he raped the woman, records show. Instead, he said she “instigated” their contact.

The Record-Times made the decision not to print the victim’s name, even though it is public under state law.
