Buck returns to court for gun rights

Seeks restoration from Johnson

DAVENPORT - A local man seeking to regain full firearm rights appeared again in Lincoln County Superior Court following complications related to a prior restoration order.

Wallace Elby Buck, 62, filed for an amendment to his firearm restoration order granted on Aug. 6, after a Washington State Patrol (WSP) background check flagged two prior misdemeanor domestic violence convictions.

The flagged convictions from April 19, 2010, and Feb. 21, 2006, prevented Buck from retrieving a family heirloom rifle from a pawn shop.

Superior Court Judge Barkdull, citing a conflict of interest due to his involvement as the prosecuting attorney in Buck's earlier cases, referred the matter back to Judge Dan Johnson, who had granted the original restoration order.

Judge Johnson reviewed Buck's amendment request in Lincoln County Superior Court on Tuesday, Jan. 7, noting that his previous assault convictions were in district court, not Superior court.

"You are just not in the right court," said Judge Johnson in Superior Court. "I restored your gun rights. The problem is the state is not recognizing them. I cant give you any relief here today"

Buck described the situation as frustrating, stating, "It is like being in a compressor. One side is saying, 'Okay, you're good,' while the other side is saying, 'not quite.'"

In his original appeal for firearm rights restoration, Buck cited two motivations: his wife's inability to retrieve the heirloom rifle and his desire to join a hunting trip with his five sons.

Buck's legal history includes nine counts of second-degree unlawful possession of firearms from Jan. 18, 2008. These charges stemmed from a 2007 incident in which Buck intervened during the arrest of his 17-year-old son.

"I am a person. I made mistakes. I have paid the price, and they still took my gun rights," Buck said.
