Court reviews firearm rights a second time
DAVENPORT— The Lincoln County Superior Court judge reviewed Wallace Elby Buck’s firearm rights restoration order on Tuesday, Feb. 11, after past domestic violence convictions raised legal concerns.
Judge Adam Walser examined the orders signed by Judge Dan Johnson, who restored Buck’s firearm rights in August.
However, prosecutors noted that Buck, 62, still had a prior domestic violence assault charge in district court, which disqualified him from possessing firearms.
“It looks like the orders that Judge Johnson signed only related to the unlawful possession of firearm charges,” Walser said. He noted that the 2016 domestic violence charges were never addressed and that there was no state-level objection at the time.
Walser signed the order but informed Buck that while he may qualify for firearm rights at the state level, federal restrictions could still apply.
“I appreciate you guys, I really do,” Buck said in court. “I thank you so much, sir.”
Buck had previously appeared in court on Dec. 31, seeking an amendment to the August order after a Washington State Patrol background check flagged two prior misdemeanor domestic violence convictions.
His attempt to retrieve a family heirloom rifle from a pawn shop was denied, prompting him to request further legal clarification.
